Buyers premium and Sales Tax- The buyers premium of 8% will be added to each successful bid. West Virginia sales tax of 6% will charges on all items except titled vehicles or the buyer provides a valid sales tax exemption form. Sales tax exemption must be claimed, and form presented before invoice is sent and paid.
Merchandise- Al items are SOLD AS IS WHERE IS WITHOUT GUARANTEE. We urge you to inspect all items carefully and satisfy yourself as to the condition and bid accordingly. WE WILL NOT BE ACCEPTING RETURNS OR ANY REFUNDS.
Payments- For most auctions settlement for payment for purchases must be made by cash, cashier checks, credit card (3% card fee), company check or a individual/business needs to have an irrevocable bank letter of guarantee of funds for the amount your highest expected bid.
A signed contract and 10% nonrefundable down payment is due at day of sale within the close of the auction and the remaining balance due at closing on or before 60 days.
Any required inspections must be completed prior to bidding. Title to be delivered free of all liens or encumbrances as more specifically set forth in the Sale Contract. All settlement and closing costs will be the responsibility of the buyer.
Shipping- Is not available, Buyer is responsible for arranging pickup within 48 hours.
Bidding Verification and Qualifications- You must be registered on our online auction site or in person the day of sale to place a bid on any item. By registering and placing a bid you agree to all terms and conditions that apply to this online/live auctions. Bidder agrees to sign the contract of sale and other documents related to the transaction, pay the 10% down payment and close the transaction within 60 days if there winning bid is accepted. All bids are final. We cannot retract or remove a bid. We respect your privacy and that of the other bidders. Bidder must be 18 years old or older. We will not release your information to anyone without your permission. This is online and live auction. Please note that approval is required to bid on this auction along with a letter of guarantee. WE SUGGEST YOU COMPLETE THE REQUIREMENTS AND REQUEST APPROVAL 48 PRIOR TO THE SCHEDULED LIVE AUCTION. Bidders will be suspended or permanently banned from the site if you, the bidder, provide false information when registering such as a false name or fraudulent contact information. Bidders will be permanently banned from this site if you are the successful bidder and you do not honor your auction bid. Furthermore, if you do not honor your auction bid legal action may be taken against you. Varners Hayday Auctions are not responsible for anyone who does not meet the approval time or requirements to bid.
Bidding- Using YOUR knowledge and experience, form your own opinion of the property and bid accordingly. If you are in doubt, DO NOT BID. The property is sold AS-IS; this is an AUCTION and all SALES ARE FINAL. Bids cannot be retracted and are binding contracts between Bidder and Auctioneer/Seller. Bidder is accountable to be informed about property and associated costs before bidding. A maximum bid can be placed on the property in the online bidding interface. A maximum bid is kept confidential. Except for properties noted “Absolute Auction,” Or “Sells To The Highest Bidder” all properties in auctions will be sold subject to seller confirmation or will have a pre-established minimum Reserve Price. Except where prohibited by law, Auctioneer may counter bid on behalf of Seller on any property up to the amount of the Reserve Price (and no such bid will result in a sale of the property). If the Reserve Price is not met, Seller is under no obligation to sell the property; however, Seller may accept a bid that is below the Reserve Price in its sole discretion.
Liability- Varners Hayday Auctions is not responsible for any computer malfunctions or interruptions in service, error and/or omission caused by any means and does not guarantee continual uninterrupted or error free service or use of the site during the Auction. Please note that all internet connections differ in their rate of speed. Your ability to bid in waning seconds of a timer may be adversely affected by your connection. View, bid and load at your own risk. The bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The auctioneer in its sole discretion may void any sale, temporarily suspend bidding and resale any items/lots that were affected by any malfunction. The decision of the auctioneer is final. Varners Hayday Auctions is not responsible for injury or damage of any kind, to anything or anyone, while previewing, bidding, loading out or conducting business.
Varners Hayday Auctions reserves the right to accept bids on behalf of internet bidders, absentee bidders, the seller, or himself. The auctioneer reserves the right to accept or reject any bid and in all cases of dispute the auctioneer’s decision shall be final.
